Legal definition of rape
Rape simply defined is the intentional penile penetration of the vagina, anus or mouth of another, without consent or a reasonable belief that the other consents. Drunkenness is not a defence to rape.
Evidence
The opinion of some is that rape cases are often difficult to prove as the evidence is often limited to the alleged victims word against that of the accused, the issue usually is whether there was consent or not.
A Judge will tell a jury when summing up the case that if there is doubt, you should return a not guilty verdict. Imagine you were on the jury; there are two versions, consent and non-consent, would you not decide the case simply on which of the two versions you believed?
