What is creditor fraud otherwise known as fraudulent trading?
Also known as fraudulent trading, the offence is brought under Section 993 of the Companies Act 2006, which states that any business carried out with the intent of defrauding creditors is an offence. This usually consists of a company continuing to trade or obtain products or credit despite becoming insolvent.
Anyone who has knowingly taken part in conducting business fraudulently will be charged, however, those in a managerial position are most likely to be accused of committing this offence.
